Electronically stored information (ESI) has been a growing concern among lawyers and IT professionals for some time. Computers are no longer glorified calculators − they have become our libraries, archives and even our means of communication. Prior to December 1, 2006, a handful of cases were the only real guide to litigators seeking to understand ‘data compilations’ under Rule 26(a)(1)(B). Today, we have rules more in line with how organizations use and store data, but without any clarifying case law. Under the new rules, litigants have a clear duty to preserve and produce, as directed by the court, relevant information stored electronically, lest they face sanctions….
