Index Engines Inc. is rolling out a data extraction feature that customers and analysts said makes it easier to find files on tape and comply with the year-old Federal Rules for Civil Procedures (FRCP).
One of the changes to the FRCP that went into effect last Dec. 1 mandates that corporations are able to produce relevant electronic documents in the case of litigation and should have that capability in place before receiving a request for specific information. That sent corporations scrambling to put such capabilities in place, especially for email records stored on tape, which is more difficult to search and retrieve information from than disk….

On one hand, parties have an obligation — and courts have created incentives — to be fully forthcoming on electronic discovery requests. On the other hand, processing and reviewing data collected from hundreds of desktops and servers can become very expensive….

INTRODUCTION
In the days preceding electronic discovery, a large corporation may have had to produce several thousand documents during the course of a typical litigation. Today, that same organization may have to produce several million documents because relevant data may exist in many forms, locations, and on various media and devices. This may include data from email messages, databases, home computers, PDA’s, corporate voice recordings, and instant messages. As the volume of electronic discoverable information expands, the need to cull–or select out only the useful information from–data sets becomes a critical component to a successful electronic document review project. However, an accurate and defensible culling process is not simple. The best practice is to leave data culling to the experts who can collect and filter data in a forensically sound manner utilizing tools that have been vetted and tested in the litigation industry in order to significantly decrease the possibility of altering or omitting relevant electronic data.

Let’s be blunt: Tape doesn’t cut the mustard when it comes to e-discovery. While industry experts consider tape a viable alternative for enterprise backup, when it’s time to retrieve stored data during litigation proceedings, tape’s a no-go.
“You’re basically asking for disaster if you rely on backup tapes for long-term preservation of business records and documents for search and retrieval,” says Mark Diamond, CEO of IT consultancy Contoural. Very few companies, he says, have the facilities to recover specific items of data from 100 to 2,000 backup tapes — especially with expensive lawyers waiting in the wings.
In an effort to avoid the kind of needle-in-the-haystack nightmare the above scenario conjures, organizations are turning to service providers for help. And, in turn, they’re getting assistance in moving years’ worth of data stored on tape to disk — or deleting it altogether….

Throughout every phase in the electronic discovery process, it is inevitable for counsel to encounter the proverbial fork in the road.
