Civil litigation in the United States is a largely self-policing activity that requires litigants to trust that their opponents are playing by the same rules as they are. Through the interface of their legal counsel, litigants who may personally (and deeply) dislike each other are nonetheless expected to cooperate in arranging the parameters of fact discovery and other logistical aspects of a case. And amazingly, more often than not, this system actually works. Sometimes, though, a party may strongly believe that their opponents are holding back relevant discovery materials in violation of their legal obligations to turn them over. If the materials are thought to be important enough, one option open to requesting parties under both federal and state rules of civil procedure is to ask the judge to permit them to inspect the materials directly instead of relying on the producing party to organize the materials for them. Such requests have been made for both hardcopy and electronic materials for many years, though somewhat remarkably for the constantly-evolving law of e-discovery, most courts have consistently denied this relief, finding it unwarranted and overly intrusive….

While trepidation and misconception have kept the legal community from adopting these discovery strategies, now this technology has the opportunity to become standard practice, that is, once we clear away the miasma of ambiguity.
In a recent United States District Court decision by Magistrate Judge Facciola, his honor touched upon the use of concept searching by referencing recent scholarship that argues concept searching is “more efficient and more likely to produce comprehensive results” than its counterpart - keyword Boolean searches. While the security and efficacy of concept searching is understood and accepted by some members of the judiciary and bar, it is unknown to or misunderstood by many others. Trepidation by those with little or no experience with concept searching, content analysis, and the underlying technology is understandable. After all, the downside of a poorly executed eDiscovery effort is enormous and can result in the loss of a case, sanctions, and large penalties and monetary awards….

The Sedona Conference has just released its Best Practices Commentary on the Use of Search and Information Retrieval Methods in E-Discovery (August 2007) for public comments. A copy may be downloaded for personal use. This Best Practices Commentary, like all of the Sedona publications, was written by a committee of expert members of The Sedona Conference, who agreed upon the content and wording. This particular group is called the “Search and Retrieval Sciences Project Team.” Writings by committee are usually an invitation for disaster, but Sedona consistently manages to pull it off, and do a first rate job, primarily, I think, because of the quality of their editors. The Editor-in-Chief for the Search Team is Jason Baron, about whom I have written several times previously, along with Executive Editors Richard Braman and Kenneth Withers, and Senior Editors Thomas Allman, James Daley and George Paul….
